- Someone who has given you his or her email address, knowing you'll use it.
- Someone who has bought a product or service from you in the past 18 months.
You also must ensure that:
- You are not using purchased lists of any kind.
- You are not sending to distribution lists that forward your email to a variety of email addresses.
- You are using your valid “originating” address.
- Your subject line does not contain false or misleading information.
- You have a working “unsubscribe” or “opt-out” link in your email.
- Your contact information, including your physical address, is part of the email.
